Consultation during the Review of Smoke-free Environments Regulations 1999

The Ministry of Health will be consulting with external stakeholders and other Government departments.

Purpose of consultation

The purpose of consultation is to ensure that all interested parties:
  • Receive prior notice of the areas included in the Review and the proposed changes to the Regulations.
  • Receive all reasonable information pertaining to proposed changes, including the rationale for the changes and the evidence upon which it is based.
  • Are given a fair opportunity to comment.
  • That proper consideration is given to submissions received prior to decisions being made.
The Ministry's main purpose in consulting is to enable interested parties to provide input into the decision-making process, particularly the impacts that the proposed changes may have.

Consultation is not the same as negotiation which implies a process which has the objective of reaching an agreement. It is not expected that consultation on the Review will result in agreement. Consultation will, however, involve more than simply notification of proposed changes.

Consultation began on 23 February 2004 with a letter to all key stakeholders informing them of the objectives and scope of the Review and the consultation process and timeframes.

That letter invited them to identify specific topics within the scope of the Review which could be usefully included in the consultation document.

First consultation document (2004)

A wide-ranging consultation on the review was undertaken in 2004. The review covered health warnings and other information on tobacco packaging, the disclosure of tobacco product constituents and their emissions, and the possibility of modifying tobacco products to reduce the harm caused by their use.

Second consultation document (2006)

The Ministry of Health is now inviting submissions on a consultation document concerning health warnings on tobacco products sold in New Zealand. Comments received in response to the earlier wider-ranging consultation document on a review of the Smoke-free Environments Regulations 1999 have been summarised. This advice and further research and information have led to the development of this second consultation document which focuses on health warnings on tobacco products. It discusses a number of issues related to health warnings and seeks comment on these matters and on specific proposals for such warnings.

Key interested parties have arranged discussions with the Ministry about the Review.

A Consultation Document will be the key means by which interested parties will be informed of the areas where Government is likely to consider changes.

The Consultation Document will draw together all the information and analysis necessary to facilitate the consultation process.

The Consultation Document will provide robust evidenced-based analysis related to any proposed changes - including likely impacts. It will clearly set out the rationale for changes in a specific area and the evidence supporting any specific change.

The Consultation Document will be written in such a way as to be easily read and understood. It will be published on the Ministry's website and available in hard copy on request. A letter will be sent to stakeholders informing them of its availability.
